AWMA recently sent a letter in response to a recent ruling by Judge Richard Arcara of the US District Court for the Western District of New York pertaining to the PACT Act ban on USPS mailing of cigarettes and smokeless tobacco.  Judge Arcara recently ruled to temporarily restrain enforcement of the PACT Act as it relates to the Seneca Free Trade Association and the Seneca Smokeshop and the mailing of these products through the US Postal Service.

In response, AWMA sent a letter supporting the NACS and NYACS amicus brief that comprehensively defends the constitutionality of the PACT Act and explains that this provision of the Act received support from a wide spectrum of stakeholders.  Judge Arcara has indicated he will make a final ruling on this issue no later than July 30th.  A copy of the AWMA letter can be found by CLICKING HERE
