AWMA Sends Memo on Implementation of PACT Act
The newly enacted Prevent All Cigarette Trafficking Act – or PACT Act - is scheduled to take effect on June 29th. AWMA sent out a memo outlining a particular provision of the newly enacted PACT Act that may impact distributors. Specifically, a provision of the new law indicates that distributors may need to register – one time only – with the U.S. Attorney General’s office. No reporting would be required – just a one-time registration with the U.S. Attorney General’s office. However, to date, no guidance or proposed regulation has been issued from the Department and there seems to be some confusion regarding whether or not distributors will actually be required to register.
AWMA is in the process of trying to get clarification on this particular provision of the new law. However, in the meantime, in light of the fact that the law takes effect on June 29th, AWMA’s counsel has suggested that members may wish to pro-actively register with the U.S. Attorney General’s office.
