AWMA Submits Comments to FDA on PACT Act

The U.S. Food and Drug Administration (FDA) recently announced an advance notice of proposed rulemaking on non-face-to-face sales and distribution of tobacco products.  Specifically, under the new tobacco law, the agency is required to issue regulations by April 1, 2012 to address the promotion and marketing of tobacco products that are sold or distributed through non-face-to-face exchange in order to keep these products out of the hands of minors.

The agency determined that additional information is needed on non-face-to-face and distribution practices for tobacco products in light of the enactment of the PACT Act.  AWMA has prepared the attached comments that were submitted this week before the deadline of December 8th.  The comments submitted by AWMA outline our concerns over the additional reporting requirements some states have requested from legitimate distributors under the PACT Act.  AWMA urges the FDA to consider our concerns regarding the over-extension of the PACT Act when preparing guidelines for the regulation of these non-face-to-face sales.

AWMA continues to work on all fronts – at the state and federal level – to address concerns over increased reporting requirements by certain states under PACT Act.  The Association will report to members on any new developments as FDA works to prepare regulations on this important issue
