AWMA Submits Comments to FDA on Violation Reporting
AWMA submitted comments to the FDA today on the newly proposed collection of information contained in the FDA’s Tobacco Product Reporting Violation Form.
Under the new proposal, FDA created a Tobacco Call Center with a toll-free number to accept information from the public about potential violations of the Tobacco Control Act. Callers are able to report potential violations of the new law and FDA will conduct subsequent targeted follow-up investigations based on the information received.
AWMA is deeply concerned that this proposed system of violation reporting could leave legitimate, law-abiding distributors open to potential misuse of the system and confusion over the new law could also lead to unnecessary investigations which would be overly burdensome for distributors.
