The FDA’s Center for Tobacco Products Chief of Compliance, Ann Simoneau, recently told attendees at the CSP Tobacco Category Review Meeting that while “nothing would please me more than to have no violations,” retailers had a “97%” compliance rate with respect to implementation of the new Tobacco Control Act regulations.  According to Simoneau, the majority of these violations were “for selling to minors.”  And, Simoneau told attendees that if a retailer has a violation they will receive a warning letter which she personally signs.  The FDA indicates that follow-up inspections will be conducted after receipt of these warning letters.  And, if warnings are not heeded then subsequent violations could result in civil monetary penalties.
