House Prepares to Consider Workforce Democracy & Fairness Act
The House Education and Workforce Committee recently reported out the Workforce Democracy and Fairness Act – HR 3094 – that addresses the National Labor Relations Board (NLRB) ambush election rulemaking that effectively denies employees’ access to critical information about unions and strips them of their free speech and dues process rights.
This bill is being supported and actively promoted by the Coalition for a Democratic Workplace (CDW)– a coalition of which AWMA is a member, along with 600 other organizations – and which was involved in successfully defeating the so-called “Employee Free Choice Act” or card check last Congress.
The NLRB has recently gained notoriety because of the agency’s issuance of a barrage of anti-business and anti-worker decisions and rules. The most recent rule involved the “ambush elections” which propose new procedures that could result in union representation elections held in as few as 10 days after the filing of a union petition. AWMA, and the members of the CDW coalition believe the current election time frames are not only reasonable, but permit employees time to hear from both the union and them employer to make an informed decisions – which would not be possible under the newly proposed timetables. HR 3094 would block the NLRB from moving forward with the ambush elections rule.
