FDA Regulation of Tobacco Product
In 2000, the US Supreme Court ruled that the Food and Drug Administration (FDA) did not have the authority to regulate tobacco products. This ruling negated the regulations issued by the FDA in 1996. Since the 2000 ruling, a number of bills have been introduced in Congress giving the FDA the authority to regulate tobacco products.
Most recently, the 108th Congress considered this issue during debate on the corporate tax bill (HR 4520). However, a strong lobbying effort by AWMA and other like-minded business and trade associations helped to defeat language in HR 4520 that would have given the FDA broad regulatory power over tobacco.
AWMA remains opposed to FDA regulatory authority over tobacco products believing such action could result in a "back door" ban on the product.
