AWMA Survey Question on PACT Act
Are you having difficulty with new state tobacco reporting requirements as the result of the newly enacted Prevent All Cigarette Trafficking Act (PACT)? If so, please let us know which states are causing problems for you and we’d also like to know which states are not problematic with respect to new reporting requirements under PACT.
AWMA has been actively involved with the implementation of the PACT Act, particularly the section justifying the states demands for additional monthly reports from distributors on sales to customers, even sales to other wholesalers and retailers. We understand that the states are not using any standard reporting form or system. Some states may not be requiring the filing of any additional data. We believe some states may be combining the PACT Act report with its tax reports.
AWMA is currently working with various parties – including the National Association of Attorneys Generals and the Federation of Tax Administrators – in an attempt to lessen the reporting burden for distributors and simplify the reporting process. In that effort, we are asking our distributor members for your particular experience with respect to those states in which you are reporting. Which states have requested additional, burdensome information as a result of PACT and which states have not been problematic with respect to the new law? This information has been specifically requested and we need as much input as we can get to give a meaningful sampling to the government authorities. We appreciate your input and be assured that we will keep any information you provide on this issue confidential.
